How does the water system work in Diamond Willow Estates ?

There is a fully modern water plant tied into 3 wells located on the property that provides water to each lot or residence. The water treatment plant is located in the North East corner of the development.  The water plant is operated by a contract licensed water plant operator within the Alberta Environment guidelines of the existing approval / permit that is in place for the development. Regular water samples are taken by the operator and submitted for analysis as is completed for any municipal water system. If you are interested in a tour of the pumphouse that can be arranged upon request a copy of the existing water Permit is available also for your information. Water service is the same as if you were located in any Alberta municipality. Each house will have a water meter installed during construction.

How does the sewer system work ?

The sewer system is a low pressure force main sewer system. This system operates in a manner where the sewer is pumped from each individual lot’s STEP sewage system into the main line under pressure. As the sewage pressure builds up in the main line the sewage flows into the sewage treatment plant. This sewage treatment plant is located in the North East corner of the development. This sewer treatment plant is operated by a contract licensed operator. For this system to operate 100% effectively there has to be a volume of sewage pumped into the mainline. This volume is not able to be achieved with less than an estimated 8 residences with families. Given the stage of the development at Diamond Willow Estates in 2022 where homes are just being built, it is the developers’ responsibility to pump out the individual septic tanks until the volume is large enough to operate the system. Once the sewage volume is large enough the system will be commissioned and pumping out of individual residences will cease.

How do I pay for water and sewer?

There will be a monthly charge of $150 from April 1, 2023, till April 1, 2025. This utility fee is collected monthly by the Developer with the proceeds being used to operate the system. On April 1, 2025 the monthly fee will be increased by the Consumer Price Index increase from April 1, 2023 to April 1 2024. The increase will take effect on June 1, 2024. Example – If CPI is 5% then new monthly rate becomes $150 plus $7.50 = $157.50. This process would then occur annually. It is the developer’s responsibility to operate the water and sewer system until the Clearwater County takes it over when the obligations of the Development Agreement regarding occupancy are met.

How do I know the developer will always be able to operate the system until the Clearwater County takes over??

There is $250,000 held in trust that if the developer becomes insolvent or doesn’t meet the obligations of the Development Agreement is able to be accessed by the HOA. This would allow the HOA to become the operator until the Clearwater County became the operator. When the Clearwater County eventually becomes the operator they will be collecting the utility fees.

How does the Home Owner’s Association ( HOA ) operate ?

The HOA is registered on title and the purchaser of a lot becomes a member automatically. Please click on the link to read a summary of its duties. There are yearly fees of $200.

What is a STEP Sewer system and what does it do ?

The STEP Sewer system is an integrated sewer holding tank that holds your sewage prior to being pumped into the low pressure force main system. The approved supplier for Diamond Willow estates is Alberta Wilbert Sales based in Calgary or Edmonton. The approximate cost of purchase / installation in the summer of 2022 is $25,000 and is to be paid / coordinated for by the lot purchaser. Hookup to existing utility services are to be coordinated with the developer and would be inspected as per the Alberta plumbing code and Clearwater County regulations. Until the development has enough residences to operate the sewage treatment plant the sewage will be pump out by the Developer. Once there is enough flow in the system the pumps in the installed STEP Sewer system are turned on and sewage enters the line. The pumpout of individual Step Sewer system stops.

How does garbage disposal work ?

This is the responsibility of the landowner at this time. This could be one of the first items to be coordinated / organized by the HOA.

How do the shallow utilities ( power and natural gas ) work ?

  1. When you require these services you would contact the utility franchise operator and arrange for hookup. Gas is provided by Rocky Gas and power is Blue Mountain Power Co -Op.

What is in place for telecommunications?

There is a fiber optic line throughout the subdivision. As each individual home is built they will have a line / conduit run to their house. The developer has contracted with Light Link Technologies to light up the existing line by fall 2023. This fiber optic system will eventually connect to the Clearwater County Broadband Rural system. This currently is located on the east side of the entrance off Everdell Road in the County ditch. This switch to the Clearwater County will be made when they activate the system. Each residence will be charged a monthly fee for this service Light Link Technologies.

What are the rules regarding what can be built ?

There are restrictive covenants on the title of each lot that describe what can be built. The restrictive covenants are to ensure the integrity, value and quality of the subdivision. Please click on the link.

Who plows the roads in the winter ?

The Clearwater County.

Who repairs the roads within the subdivision ?

The Clearwater County.

Who cares for lawn maintenance in common areas and is this included in the HOA fees?

Roadside ditches are maintained by the Clearwater County. The Conservation (common areas) is maintained by the HOA and developer.

How long do I have to build once I purchase a lot from the developer?

From the date of sale you have 2 years to complete your home build.

Can any home builder or individual buy a lot in Diamond Willows to build a home on ?

Yes, the design though would have to be within the guidelines of the HOA, restrictive covenants and the Clearwater County regulations.

What is the minimum size of residence that can be built?

The minimum size is 1000 sq ft.

What are is the zoning requirements as required from Clearwater County on the property lot when I purchase ?

Diamond Willow Estates zoning in Clearwater County falls under land use 13.4 (3) residential district. This bylaw section covers off the permitted uses for residential house and other buildings on the same property, discretionary uses for land other than residential lots within Diamond Willow Estates, lot sizing and communal water and wastewater services in relation to lot sizing, minimum residential house size ( 1000 sq feet ), setbacks from property lines, maximum height of houses 8 meters, maximum height of other buildings 5 meters and design, character and appearance of buildings as approved by the Development Officer. A copy of this zoning is available for review when you contact the realtor.

What are the restrictive covenants that are on title as registered by the developer ?

These covenants were put in place by the developer to help ensure the value of the properties as they are sold and built on in Diamond Willow Estates. Some items included are the HOA has a say in the appearance of buildings, purchasers have to hook up to communal water / wastewater system, lots must be kept in a neat clean, reasonable condition, residential garbage to be stored so no nuisance with surrounding properties occurs and other common sense items. A copy of these restrictive covenants are available when you contact the realtor.

Can only single family residential lots be built in Diamond Willows ?

No, there can be multigeneration living residences ( more than 1 residence with an additional structure which may include living quarters )  built in Diamond Willows. These types of developments are subject to the approval of the Developer and Clearwater County. If you are considering this type of home please contact the realtor.

What are my approximate taxes ?

The approximate taxes for 2022 as assessed by Clearwater County are $600 per year for every $100,000 of value as determined by the assessor. For example a $700,000 home would be approximately $4200 a year ( 7 x $6000 ). Please review the Clearwater County website which contains additional information.
